मन में रखो विश्वास - मनीष मेहरोत्रा

मन में रखो विश्वास करते रहो निरंतर प्रयास ; परिणाम की इच्छा ना भटकने दो आस पास। आशाओं के दीप जलाते रहो ; साथ साथ आज को आज की तरह अपनाते रहो। सपना जो तुमने आज बुना है , वो कल अवश्य पूरा होगा ; बस धीरज से काम लेना होगा। याद रखो कि समय है बहुत बलवान ; आदमी आज फ़क़ीर तो कल है धनवान। जो तुमने हिम्मत से लिया काम ; तो एक दिन अवश्य मिलेगा तुम्हें तुम्हारा धाम। यह भी जानो की यह संसार माया की छाया है ; मनिषयों ने सत्य को इसके पीछे ही छिपे पाया है। धन , शक्ति और मान, यह तीनो है ईश्वर के वरदान ; इनके कारण कभी ना करना तुम अभिमान , और इनके लिए कभी ना खोना अपना स्वाभिमान। अपने आत्मा बल को बनाए रखो जीवन में हौसले की शक्ति जगाए रखो ; बहती हुई नदियों ने हमें दिखाया है ,  उन्हो ने अपना रास्ता स्वयं ही बनाया है। उगता हुआ सूरज है इस बात का पैग़ाम ; जीवन ऊँचे उठने का ही है नाम। मन में रखो विश्वास करते रही निरंतर प्रयास ; परिणाम की इच्छा ना भटकने दो आस पास। स्व रचित शिमला २/८/१९९२ प्रा: ११.२५ मिनट

MEDICAL NEGLIGENCE CASE - IS THE EXPERT OPINION RECEIVED BINDING ON THE COURT ?

  11.3.2 It is well-settled that a Court is not bound by the evidence of an expert, which is advisory in nature. The Court must derive its own conclusions after carefully sifting through the medical records, and whether the standard protocol was followed in the treatment of the patient. The duty of an expert witness is to furnish the Court with the necessary scientific criteria for testing the accuracy of the conclusions, so as to enable the Court to form an independent opinion by the application of  this criteria  to the facts proved by the evidence of the case. DUTY OF DOCTOR TO INFORM THE RISKS

Medical Negligence and Duty of Care 11.4.1 Medical negligence comprises of the following constituents: (1) A legal duty to exercise due care on the part of the medical professional; (2) failure to inform the patient of the risks involved; (3) the patient suffers damage as a consequence of the undisclosed risk by the medical professional; (4) if the risk had been disclosed, the patient would have avoided the injury; (5) breach  of the said duty would give rise to an actionable claim of negligence.
